Terms of use
Last updated: 18/10/2026. Please read these terms carefully. By creating an account, or by using Uswapped in any way, you agree to them.
## 1. Who we are and what these terms cover
1.1 Uswapped (“we”, “us”, “our”) is operated by Zinoko Limited, a company registered in Ireland (company number 708463) with its registered office at Crossabeagh, Knockbridge, Co. Louth, Ireland.
You can contact us at [email protected] or [email protected].
1.2 These terms apply to our website, our mobile apps and every service we provide (together, the “Service”). They form a binding agreement between you and us. They include our Privacy Policy, our Stay Safe guidance, our How Credits Work page and any rules shown in the Service when you list an item, make an offer or use a feature (together, the “Terms”).
1.3 If you don’t agree to the Terms, don’t use the Service.
## 2. What Uswapped is, and what it is not
2.1 Uswapped is an online venue where members can list items they no longer need and agree to swap them with each other. Swaps are arranged between members. Items are swapped for other items or for credits. Where a member has chosen to offer an item for sale by card (Buy Now), or where a verified charity shop sells an item by card, the buyer pays the price shown through our payment provider (see sections 7A and 10A).
2.2 We provide the tools only. We are not the owner, seller, buyer, swapper, auctioneer, agent, carrier, insurer or guarantor of any item or of any swap. Every swap is a contract directly between the two members involved, and we are not a party to it.
2.3 We do not inspect, test, verify, authenticate or take possession of items. We don’t check that listings are accurate, lawful or safe, or that members are who they say they are or will do what they promise. Any checks we carry out (for example price guidance, automated filters, identity or email confirmation, reviews or badges) are an aid only. They are not a guarantee, and you must not rely on them in place of your own judgement.
2.4 We do not control, and are not responsible for, what members do, say or send, whether on or off the Service.
## 3. Eligibility and your account
3.1 You must be at least 18 years old, able to enter a legally binding contract, and not barred from using the Service by any law. If you use the Service for a business, you confirm that you have authority to bind it.
3.2 You must give accurate, current and complete information when you register and keep it up to date. One person may hold one personal account. You may not create accounts to get around a suspension, limit or review decision.
3.3 You are responsible for keeping your password and devices secure, and for everything done through your account. Tell us at once if you think someone else has used it. We are not liable for loss caused by unauthorised use of your account unless the law says otherwise.
3.4 If you sign in with Google, Facebook, X or another provider, that provider’s own terms also apply to you, and we are not responsible for their service.
3.5 You must not sell, transfer, rent or share your account or your credits.
## 4. Your listings: you are responsible for them
4.1 You are solely responsible for every listing you create and for all the content you upload or send through the Service, including titles, descriptions, categories, condition, photos, credit values, delivery details, messages and reviews (“Your Content”).
4.2 When you create a listing you promise that:
- you own the item or have the full legal right to give it away or swap it, and nobody else has a claim, lien, finance agreement or other right over it;
- the item is not lost, stolen, counterfeit, recalled, or obtained by fraud or breach of any law;
- the description, condition, age, size, brand, authenticity, working order and any faults are accurate, complete and not misleading, and your photos show the actual item;
- the credit value you choose is a genuine, good-faith estimate, and you are not using it to mislead anyone, avoid our checks or manipulate credits;
- the item is legal to own, post and give away in Ireland and anywhere you agree to send it, and it meets all applicable safety, labelling, hygiene and quality laws and standards;
- you have the right to upload your photos and text and they do not infringe anyone’s copyright, trade mark, privacy or other rights, and show no other person’s face, address or personal data without permission.
4.3 You must check your listing is accurate before you submit it, and correct it straight away if something changes or turns out to be wrong. Hiding or leaving out a fault is a breach of these Terms.
4.4 We may leave a listing up, hold it for review, edit its category, hide it or remove it at any time, with or without notice, but we have no duty to review or monitor listings, and not doing so is not an approval.
4.5 You are responsible for any consequences of a listing, including claims by other members or third parties, fines, penalties, product liability, or loss or damage arising from the item.
4.6 If you list items as part of a business or trade, you must tell us, identify yourself in the way we require, comply with all consumer, product safety, tax and other laws that apply to traders (including information, labelling, returns and withdrawal rights), and not present yourself as a private person. We may ask you for proof of identity and trading details, and may refuse or remove trader listings.
## 5. Prohibited and restricted items
5.1 You must not list, offer, request, send or receive:
- anything illegal to own, sell, give away or post in Ireland, or that breaks any law, regulation or court order;
- stolen goods, counterfeit or replica branded goods, or items that infringe intellectual property rights;
- weapons, firearms, ammunition, imitation firearms, knives or blades intended as weapons, explosives, fireworks, and anything designed to cause harm;
- drugs, drug paraphernalia, alcohol, tobacco, vapes and nicotine products, prescription or over-the-counter medicines, medical devices, and anything controlled or age-restricted;
- live animals, animal parts, and items made from protected or endangered species;
- hazardous, flammable, corrosive or toxic goods; batteries or products that are damaged, recalled or unsafe; child car seats, helmets, cots or other safety equipment where its safety history is unknown or it is past its safe life; and cosmetics, food and drink;
- personal data, mailing lists, accounts, digital goods, licenses, gift cards, vouchers, tickets, currency, securities or anything of cash value, unless we have specifically enabled it;
- adult or sexually explicit material, offensive, hateful or discriminatory items, and items that glorify violence or terrorism;
- services, jobs, adverts, property, vehicles, or anything that isn’t a physical item that can be posted;
- anything we tell you in the Service is not allowed, or that we decide, acting reasonably, is unsuitable.
5.2 You are responsible for finding out whether an item is lawful and safe to give away and post. This list is not complete and does not make anything else permitted.
5.3 You must check that nothing you list has been recalled. Do not list an item with a known safety defect.
## 6. Conduct rules
6.1 You must not:
- break any law, or encourage others to do so;
- post anything false, misleading, defamatory, threatening, harassing, abusive, discriminatory, obscene or that invades anyone’s privacy;
- take payment, goods or credits outside the Service, ask another member to pay you money, or use the Service to sell for cash;
- try to take a swap or a conversation off the Service in order to avoid rules, checks or fees, or to defraud anyone;
- create fake, duplicate or misleading accounts, listings, offers, swaps, referrals or reviews, or trade credits between accounts you control to gain rewards;
- manipulate reviews, ratings, badges, referral or invite rewards, promotions or credit balances;
- send spam or unsolicited promotions, or collect other members’ information;
- upload viruses or harmful code, probe, scan or test the security of the Service, bypass any limit or access control, or interfere with how it works;
- use bots, scrapers or automated tools without our written permission, or copy, reverse engineer or resell any part of the Service;
- impersonate any person or organisation, or misrepresent your connection with them;
- use another member’s address or information for anything other than completing the swap you agreed.
- other than through Buy Now or a charity shop’s card sale as set out in sections 7A and 10A.
6.2 You must treat other members with respect and be honest about your items and your intentions.
## 7. Swaps between members
7.1 When a member makes an offer and the other member accepts it, they have agreed a swap. That agreement is between the two members only. Each member must carry it out in good faith.
## 7.1.1. Verified charity shops
7.1.2 “verified charity shop” is a charity or charity shop that has applied to us and been approved after we checked the details and documents it gave us. A badge or label showing that a shop is verified is an aid only. It is not an endorsement, and we do not guarantee how a shop runs, what it sells or what it does with money it receives.
7.1.3 A shop lists items it holds in its shop. Items can be bought from a shop by card, by paying credits, or by offering one or more of your own items in exchange. Which of these a shop accepts for a given item is shown on the item page. A shop may decline an offer of items or credits, and a decline or a cancelled offer returns any credits held.
7.1.4 Items bought from or swapped with a shop are collected from the shop. The shop gives you a code after you have paid or the offer is accepted. You give the code to the shop when you collect, and the shop confirms the handover in the Service. There is no postage. You are responsible for collecting within the time shown in the Service (normally 14 days). If you do not, the order or swap may be cancelled, and any card payment refunded or credits returned as shown in the Service.
7.1.5 Where you offer your own items to a shop, you must bring them to the shop. The shop decides whether to accept them when you hand them over. Sections 4 and 5 apply to your items.
7.1.6 A shop is solely responsible for the items it lists, their description and condition, its stock, its opening hours and its dealings with you. Shops pay no swap fee. We may charge a shop a subscription or other fees that we tell the shop about.
7.1.7 We may remove a shop’s verified status and listings if its details are no longer accurate, if it breaks these Terms, or for the safety of members.
7.2 Items are swapped as seen, in the condition described, and we are not responsible for their quality, condition, safety, authenticity, suitability, legality or value. You are responsible for deciding whether to accept an offer and for checking the listing and asking questions beforehand.
7.3 After a swap is agreed each member must send their item promptly, carefully packed, to the address the other member provides in the swap, within the time shown in the Service. A member who does not send their item, or who sends something materially different from the listing, may be dealt with as set out in section 13.
7.4 Credits used to even out a swap are held by us while the swap is in progress and released as described in section 9. We are not liable for any loss caused by how we apply our rules in good faith, including releasing credits, refunding them or leaving a swap open while it is checked.
7.5 When you receive an item, check it and confirm delivery or raise a problem within the time shown in the Service. If you don’t, the swap may be treated as completed and the credits released automatically. You must tell us about problems in good time. Late claims may not be considered.
7.6 You are responsible for taking reasonable care when sending and receiving items. Meeting in person is outside the Service, and if you choose to do it you do so entirely at your own risk and should follow our Stay Safe guidance.
7.7 Between private members, a swap is a private arrangement and the rights and remedies that apply to goods bought from a business may not apply. Between members, items cannot be returned simply because a member has changed their mind, unless both members agree. If one of the members is acting as a trader, the law may give the other member additional rights, and the trader is solely responsible for them.
7.8 Risk of loss or damage in the post, and responsibility for the item while it is in transit, is between the members and their chosen carrier. We do not insure items, and we are not responsible for lost, delayed, damaged, seized or undelivered parcels.
7.9 We may cancel, reverse, or refuse to process any swap we reasonably suspect involves fraud, a prohibited item, a breach of these Terms, an error, or a risk to anyone’s safety.
## 8. Postage, packing and delivery
8.1 Each member sends their own item at their own cost, unless we clearly say otherwise in the Service. You are responsible for choosing a suitable carrier and service, packing the item properly, paying for postage, any customs duties, taxes or charges, and checking carrier rules on what can be posted.
8.2 Any parcel label, address sheet, tracking field or carrier link that we provide is a convenience only. It does not make us a party to the carriage contract. We don’t guarantee that any carrier will collect, deliver or handle an item properly. Any carrier’s own terms and liability limits apply, and claims for loss or damage must be made to the carrier by the person who bought the postage.
8.3 If you buy a carrier label through us, we act as a booking convenience only. The carrier is solely responsible for delivery. We may refuse or cancel labels and may charge you for the cost.
8.4 We are not responsible for incorrect addresses supplied by a member. Keep proof of postage and tracking information. You are responsible for entering correct tracking details.
8.5 You may use another member’s address only to complete the swap, and you must delete it afterwards and never share or misuse it. The postage rules in this section do not apply to items collected from a charity shop (see section 7A).
## 9. Credits
9.1 Credits are a prepaid balance that can be used within the Service only. One credit is intended to be worth about one euro for the purposes of valuing items, but a credit is not money, is not electronic money, is not a deposit, a bank account, a voucher with a cash value or a financial product, and does not earn interest.
## 9A. Cashing out earned credits
9A.1 Only credits earned from completed swaps can be cashed out. Credits you bought, and credits from rewards, promotions or referrals, cannot.
9A.2 To cash out you must request it in the Service, give a bank account (IBAN) in your own name, or, for a verified charity shop, in the name of the charity or shop, and confirm that you are entitled to the money. We may require identity checks and may refuse, delay or reverse a request we reasonably suspect involves fraud, error or a breach of these Terms or the law.
9A.3 Cash-out is subject to a fee, a minimum and maximum amount per request, a monthly limit, a waiting period before payment and, for members other than verified charity shops, a minimum number of completed swaps and a minimum account age. These are shown in the Service when you request a cash-out and we may change them. Changes do not affect requests already made.
9A.4 When you request a cash-out, the credits are taken from your balance straight away. If we reject the request, they are returned. Once we have paid it, the credits are gone and the payment cannot be recalled. You are responsible for entering the correct bank details.
9A.5 A cash-out is a payment to you for goods you swapped. You are responsible for any tax on it. We may report cash-out payments to tax and other authorities where the law requires it.
9A.6 We may suspend or withdraw cash-out at any time, for example for legal, security or fraud reasons.
9.2 Credits cannot be transferred to anyone, sent between accounts, sold, or used outside the Service, except where we specifically make a feature available and say so (for example gift cards or donations, which are provided by or with third parties and may have their own terms). Credits you have earned from completed swaps (and no others) may be cashed out as set out in section 9A.
9.3 You can obtain credits by buying them, receiving them in a swap, or through rewards or promotions. We may set limits on buying, holding, using or releasing credits, and we may change prices, fees and how credits work, but we will not reduce the balance you have already paid for except as these Terms allow.
9.4 Credits you buy are generally non-refundable once purchased, except where the law requires a refund, where we choose to give you a refund, or where we cancel the Service. Credits received through rewards, offers, referrals or promotions have no cash value, may have conditions, and may be withdrawn if the conditions are broken or the reward was obtained in error or by abuse.
9.5 We may adjust, correct, reverse or remove credits if we reasonably believe there was an error, fraud, abuse, a chargeback, a prohibited item, or a breach of these Terms. If your account is closed or suspended for breaking these Terms, we may keep or cancel remaining credits that were obtained improperly, and we may withhold credits while we investigate.
9.6 If you close your account, we will deal with any remaining paid credits as set out in the Service and the law.
9.7 Fees (for example swap fees or listing boosts) are shown before you confirm and are not refundable once the service has been provided, except as the law requires.
9.8 You are responsible for any tax that arises from your use of the Service, including on items you swap or credits you receive. We do not give tax advice.
9.8.1 A verified charity shop (see section 7A) can be paid in credits for items you buy from it, and can cash those credits out under section 9A.
9.9: Paying a shop in credits is a purchase from the shop: once the shop has handed the item over, the credits are not refundable except as the shop agrees or the law requires.
## 10. Payments
## 10A. Buying by card and seller payouts
10A.1 Some listings can be bought by card (“Buy Now”). The price, any postage and any fee we charge are shown before you pay. The payment is taken by our payment provider (Stripe). We do not store your card details.
10A.2 When you pay, the seller is bound to supply the item. We hold the payment, through our payment provider, until the buyer has confirmed delivery or the confirmation period set in the Service has ended, and then release it to the seller, less any fee. If the seller does not post the item in time, or the order is cancelled or successfully disputed, the buyer is refunded.
10A.3 To sell by card, a seller must first complete identity and bank verification with our payment provider. Verification is carried out by the provider under its own terms, and we receive only the result. We may refuse or remove card sales at any time.
10A.4 If a payment is reversed by the buyer’s bank (a chargeback), we may recover the amount from the seller, including from later payouts, and may suspend the seller’s ability to sell by card.
10A.5 Card sales are between the buyer and the seller. If the seller is a trader, the buyer may have additional rights under consumer law, and the trader is solely responsible for them (see section 7.7). Fees we charge are not refundable once the sale has completed, except as the law requires.
10A.6 Sellers are responsible for their own tax on money they receive.
10A.7 You can also pay for some services, such as listing boosts, by card. These are processed in the same way and are covered by section 9.7.
10.1 Payments for credits are processed by third-party payment providers (such as Stripe). We do not store your full card details. The provider’s own terms apply and we are not responsible for their service or for any delay, error or fee they charge.
10.2 You must only use payment methods you are entitled to use. If a payment is reversed or disputed, we may remove the credits and suspend your account.
10.3 You are responsible for the accuracy of the payment details you give and for any charges your bank makes.
## 11. Reviews, messages and member content
11.1 You may rate and review other members honestly, based on your real experience. Reviews must be truthful, fair and lawful. We may remove a review that breaks these Terms.
11.2 Messages are for arranging swaps only. We may filter, scan, review and keep messages to run and protect the Service, for safety, and to resolve disputes, in line with our Privacy Policy.
11.3 What members say or post is their own view, not ours. We are not responsible for it.
## 12. Intellectual property and your license to us
12.1 We own, or are licensed to use, the Service, our brand, software, design and content (other than Your Content). You may not copy or exploit them except as these Terms allow.
12.2 You keep ownership of Your Content. By uploading it you give us a free, worldwide, non-exclusive, sub-licensable license to host, store, copy, reproduce, adapt (for example resize or crop), display, share and distribute it in connection with running, promoting and improving the Service, including in previews, emails, notifications, our website, apps and social media. This license continues for a reasonable period after you remove Your Content, where it has been shared or backed up, and as the law requires.
12.3 You promise you have all the rights needed to give us that license, and that Your Content does not infringe anyone’s rights.
12.4 If you believe content on the Service infringes your rights, use the reporting tools or contact us at [email protected] with details so we can look into it. We may remove content and suspend repeat infringers.
## 13. Problems, reports and disputes between members
13.1 If something goes wrong with a swap, first try to sort it out with the other member through the Service. You can report a problem or open a dispute from the swap page within the time shown.
13.2 We may, but are not obliged to, look into a report or dispute. If we do, we act as a neutral helper, not as a judge. We may ask for evidence such as photos, tracking information and messages, may decide to release, return or hold credits, may remove listings, and may warn, limit or suspend members. Our decision is made reasonably and in good faith on the information available, may be imperfect, and is not a legal ruling.
13.3 We do not guarantee any outcome, and nothing in the dispute process stops you from pursuing your own legal rights against the other member. We are not liable for the outcome of any dispute between members.
13.4 You agree to give us honest and complete information when we ask. Giving us false information is a serious breach of the Terms.
## 14. Reporting illegal or harmful content, and how we moderate
14.1 You can report any listing, message, review, profile or other content you believe is illegal or breaks these Terms using the report tools in the Service, or by emailing [email protected]. Please include a clear explanation of why you think it is a problem and where we can find it.
14.2 We aim to review reports in good time and act on them diligently. We may remove or restrict content, limit visibility, suspend or close accounts, refuse credits, or report matters to the authorities, at our discretion and without notice where we think it necessary for safety, legal or fraud reasons.
14.3 When we remove content or restrict an account because it is illegal or breaches these Terms, we will explain our reasons to the affected member where the law requires and where we are able to, and tell them how to complain.
14.4 If you disagree with a decision we have made about your content or your account, you can complain to us at [email protected] within six weeks, and we will review your complaint in good time by a person. You may also have the right to use an out-of-court dispute settlement body certified under the EU Digital Services Act, or to go to court.
14.5 We may cooperate with and share information with the Garda Síochána, regulators, courts and other authorities, and with other platforms for fraud prevention, in line with the law.
## 15. Suspension, restrictions and ending your account
15.1 You may close your account at any time from the Account page, once any swaps in progress are complete or settled.
15.2 We may refuse access, limit, suspend or close your account, remove your content, or withhold credits at any time if we reasonably think you have broken these Terms or the law, put anyone at risk, damaged our reputation, caused us loss, or for security or legal reasons. Where possible and lawful we will tell you why.
15.3 When your account ends, your right to use the Service stops. Anything that by its nature should continue (such as sections on your responsibility for content, intellectual property, disclaimers, liability, indemnity and governing law) continues. We may keep data as the law requires and as described in our Privacy Policy.
## 16. Third-party services and links
16.1 The Service may use or link to services provided by others (for example sign-in providers, payment processors, carriers, cloud hosts, email, notification and mapping providers, gift card suppliers and charities). We don’t control them and are not responsible for them, their content, availability, security or practices. Your use of them is at your own risk and under their terms.
16.2 Any mention of a third party or a charity does not mean we endorse them.
## 17. Notifications and communications
17.1 We will send you service messages (for example about your swaps, credits, security and changes to these Terms) by email, in-app notification and, if you turn them on, push notification. You can manage some of these in your settings, but you can’t switch off messages we need to send to run your account or meet legal duties.
17.2 We will only send you marketing if the law allows, and you can opt out at any time.
17.3 You are responsible for keeping your contact details up to date. Messages we send to the details you gave us are treated as received.
## 18. Your personal data
18.1 We handle personal data as set out in our Privacy Policy. When you swap with another member, they receive the details needed to complete the swap, such as your name and delivery address, and you must use another member’s information only to complete the swap and keep it secure.
18.2 You must follow data protection law, including the GDPR and the Data Protection Acts, in relation to any personal data of others that you receive or upload. Do not upload photos or details of other people without their permission.
## 19. Availability, changes and updates
19.1 We try to keep the Service running, but we don’t promise it will always be available, error-free, secure or uninterrupted. We may suspend, change or withdraw all or part of it (including features, limits, fees, categories and the apps) at any time, for maintenance, security, legal or business reasons, with notice where reasonable.
19.2 We may release updates to our apps. Some features may need an up-to-date device or app version to work.
19.3 We are not responsible for failures caused by things outside our reasonable control, including internet, power, hosting, carrier or third-party outages, cyber attacks, strikes, extreme weather or changes in the law.
## 20. Disclaimers
20.1 The Service and everything on it is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranties or promises of any kind, express or implied, including about the quality, safety, legality, accuracy, authenticity, availability, fitness for a purpose or non-infringement of the Service, any item, any member or any content, or that any swap will be completed.
20.2 We don’t guarantee any particular result from using the Service, including that you will find a swap, that an item will have any value, or that any member will behave honestly or lawfully.
20.3 Any price guidance, suggested credit value, search result, recommendation, rating, badge or “trusted” label is for information only and is not a valuation, appraisal or promise.
20.4 Nothing here is legal, tax, safety or professional advice.
## 21. Our liability
21.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights.
21.2 Subject to 21.1, and to the fullest extent the law allows, we are not liable to you for:
- anything that arises from a swap, an item, a listing, Your Content or the acts or omissions of other members or third parties (including carriers, payment providers and sign-in providers);
- any loss, damage, theft, delay, seizure or non-delivery of an item;
- any loss of profit, income, business, opportunity, goodwill, savings or data, or any indirect, special or consequential loss, whether or not we were told it was possible;
- any loss caused by your breach of these Terms or the law, by your failure to protect your account, or by relying on information on the Service.
21.3 Subject to 21.1, our total liability to you for all claims arising from or connected with the Service or these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of (a) the amount you paid to us in the 12 months before the claim arose and (b) €100.
21.4 If you use the Service as a business or trader, you accept that all our liability to you is excluded to the fullest extent the law allows, other than as stated in 21.1.
21.5 Some limits in this section may not apply to you if you are a consumer in a country where the law does not allow them. In that case they apply only to the extent the law allows.
## 22. You indemnify us
22.1 You agree to compensate and keep us (and our directors, owners, employees, contractors, partners and agents) safe from any claim, demand, loss, damage, cost, fine or expense (including reasonable legal fees) arising from or connected with: Your Content, your listings and items; your swaps and any dispute with another member; your breach of these Terms or any law; your infringement of anyone’s rights; any tax or duty you owe; or your misuse of the Service or of another member’s data.
22.2 We may take over the defense of any claim, and you must help us. You must not settle any claim that affects us without our written consent.
## 23. Changes to these Terms
23.1 We may update these Terms from time to time, for example for legal, security, regulatory or business reasons, or because we change the Service. We will tell you about material changes in advance, by email, in the Service or on this page, and the date at the top will change.
23.2 If you keep using the Service after the changes start, you accept them. If you don’t agree, you must stop using the Service and close your account before they start.
## 24. General
24.1 Entire agreement. These Terms, with the pages they refer to, are the whole agreement between you and us about the Service and replace any earlier understanding.
24.2 If any part of these Terms is found to be invalid or unenforceable, the rest continues in effect, and the part will be replaced with a valid one that comes closest to its intention.
24.3 If we don’t enforce a right straight away, we haven’t given it up.
24.4 You can’t transfer your rights or duties under these Terms. We can transfer ours to a successor, an affiliate or someone who takes over the Service, and we will tell you if that affects your rights.
24.5 No one other than you and us has any right to enforce these Terms.
24.6 We may give you notices by email, through the Service or by post to the details you gave us. You can contact us at [email protected].
24.7 Nothing in these Terms creates a partnership, joint venture, agency or employment between you and us, or between members and us.
24.8 Where we are required by law, we may collect, hold and report information about members and their activity to tax and other authorities.
24.9 Regulatory information. Our single point of contact for authorities and for users, as required under the EU Digital Services Act, is [email protected].
## 25. Governing law and disputes
25.1 These Terms, and any dispute or claim arising out of or connected with them or the Service (including non-contractual disputes), are governed by the laws of Ireland.
25.2 The courts of Ireland have exclusive jurisdiction, except that if you are a consumer living in another EU country you may also bring a claim in the courts of your home country, and the mandatory consumer protection rules of your home country continue to apply to you.
25.3 Before starting court proceedings, please contact us first so we can try to resolve the matter informally. Consumers may also use the EU’s online dispute resolution options where available.
## 26. Contact
